Do you have a judgment against you? And your bank account has been restraint by any law firm. You don’t have knowledge about the lawsuit including the judgment. You can stop garnishing money from your bank account by the Marshal. In this regard what you have to do, ask the law firm for a copy of the judgment, and all other related papers from beginning to end, i.e. Summons and complaint, affidavit of service, etc.

Go to the court where from the judgment was entered against, see a court clerk, file an Order to Shaw Cause OSC), where you will mention that you want that the judgment be vacated (put any reason, such as you never received any summons or complaint, and you have no knowledge about the alleged debt or money judgment). File the OSC with the court for signature by the judge, as soon as judge sign the OSC then you have mail a copy probably by certified mail to the Bank and to the law firm.

There would be a court date for hearing on the OSC and you have to present on that date to prove that the judgment was entered unlawfully. If you are planning or have already signed a contract to a house, make sure the house that you are about to buy should be completely vacant, i.e. no tenants, or even the seller. In this process you have to spend lot of money by paying the attorney fees, court fees, marshal fees, process server fees, etc. and at the same time it’s a hassle.
